Spain takes historic step toward legalizing medical cannabis

Personal usage of marijuana was decriminalized in Spain many years ago, but the move is still significant

In a historic move, Spain’s Council of Ministers has approved a decree to establish a medical cannabis framework in the EU nation. The decision follows years of extensive campaigning efforts by advocates and patients.

Like other countries that have authorized the prescribed usage of the plant, it will be provided to those with conditions such as epilepsy, multiple sclerosis, cancer and chronic pain. However, it is very notable that the decree only covers cannabis oil and excludes the prescription of flower.

“The rule responds to the need to offer a therapeutic alternative in cases where conventional treatments are not effective,” said Spain’s Health Ministry in a social media post on Oct. 7. “Master formulas with standardized cannabis preparations can only be prescribed by specialist doctors and should be prepared and dispensed exclusively in hospital pharmacy services under individualized clinical supervision.”

The European nation’s Congress still needs to give the decree a final stamp of approval after considering possible amendments. As multiple major political parties have backed medical cannabis regulation, it is highly unlikely that it will be rejected.

Despite having no prior medical framework or adult-use market, Spain has long maintained a relaxed stance about personal cannabis use. Citizens have been free to possess small quantities, consume in private spaces and cultivate two or three plants in their homes since 1992.

Hundreds of cannabis social clubs currently operate freely throughout the country.

Public operators voice their enthusiasm

The Spanish government’s decision was well-received by major players in the global cannabis sector.

Multinational operator Curaleaf Holdings Inc (TSE: CURA) (OTCMKTS: CURLF) described the development as an encouraging move towards evidence-based access.

“A small but meaningful step forward for patients in Spain,” the company said.

Furthermore, Tilray Brands Inc (TSE: TLRY) (NASDAQ: TLRY) (FRA: 2HQ) CEO Irwin D. Simon applauded the move.

“By focusing on precise dosing, rigorous oversight, and access for those facing chronic pain, severe epilepsy, nausea and vomiting associated with chemotherapy and spasticity associated with multiple sclerosis, Spain is demonstrating leadership in putting science, safety, and patient well-being at the forefront,” he stated.

Tilray is currently in the midst of a clinical trial in Spain evaluating the impact of medical cannabis on glioblastoma patients. Glioblastoma is a severe form of brain cancer.

Additionally, Canadian operators Organigram Global Inc (TSE: OGI) (NASDAQ: OGI) (FRA: 0OG) and Aurora Cannabis Inc (TSE: ACB) (NASDAQ: ACB) (FRA: 21P) were quick to express their unequivocal assent for the nation’s decision.

“As medical frameworks continue to evolve across Europe, this decision reinforces the growing recognition of cannabis as a legitimate therapeutic option, grounded in science and compassion,” Organigram said.

“A landmark moment for the region and a step in the right direction” Aurora stated.
